Terms of Service
Effective October 2, 2026
These Terms of Service apply to your use of lexiemariephoto.com and of the online galleries, downloads, and print store provided by Lexie Marie Photography LLC ("Lexie Marie Photography," "we," "us"). By using our website or gallery, you agree to these terms. If you have booked a session or wedding with us, your signed contract governs that booking; where these terms and your contract differ, your contract controls.
Copyright and Ownership
All images, website content, and branding are the property of Lexie Marie Photography and are protected by U.S. copyright law. Lexie Marie Photography keeps the copyright to all images it creates, including images delivered to clients.
Personal Use License
Clients receive a personal use license for the images delivered in their gallery. This means you may:
Print your images for personal use
Share your images on personal social media and with family and friends
Use your images in personal projects such as albums, cards, and invitations
You may not sell, license, or use the images for commercial or advertising purposes, enter them into contests, or edit, filter, or alter them without our written permission. When you post your images on social media, please tag @lexiemariephoto and share them as delivered, without filters or color changes. Vendors and publications who wish to use images must request permission and credit Lexie Marie Photography.
Online Galleries
Your gallery is private and shared only with you and anyone you choose to share the link with. You are responsible for who has access to your gallery link. Galleries remain available for 12 months from delivery unless your contract states otherwise, after which they are archived. Please download and back up your images promptly; we are not responsible for images lost after the gallery expires. We keep copies of edited images for about one year but do not archive them permanently. If an archived gallery can still be restored, an unarchiving fee applies as stated in your contract.
Print and Product Orders
Prints and products ordered through your gallery are produced by professional labs. Prices and shipping charges are shown at checkout. Because each product is custom made, orders cannot be canceled once submitted. If a product arrives damaged or defective, contact us within 14 days of delivery with photos of the issue and we will work with the lab to make it right. Color may vary slightly between screens and printed products.
Payments
Session, wedding, and product payments are handled through secure third-party processors. Retainers and payment schedules are set out in your contract and are non-refundable except as stated there.
Website Use
You agree not to copy, download, screenshot, or reuse images or content from our website or galleries except as allowed by your personal use license, and not to use the site for any unlawful purpose.
Limitation of Liability
Our website and galleries are provided "as is." To the fullest extent permitted by law, Lexie Marie Photography is not liable for indirect or consequential damages arising from your use of the website or gallery. Our total liability for any claim relating to a gallery or product order will not exceed the amount you paid for that order.
Privacy
Your use of our website and gallery is also governed by our Privacy Policy.
Governing Law
These terms are governed by the laws of the State of Michigan. If you have a signed contract with us, the dispute-resolution terms in that contract, including arbitration in Ottawa County, Michigan, apply.
Changes to These Terms
We may update these terms from time to time. The effective date above shows when they were last revised.
